1 INTRODUCTION
These Terms and Conditions, together with the privacy policy, constitute the agreement between you (The Client) and FlowMotion Pilates in relation to your use its services. “Services” means any information, activities, classes, workshops, or private sessions provided by FlowMotion Pilates. Please read the Terms and Conditions carefully and in full.
You hereby agree and confirm by making purchases and booking Services with us that that you have read The Terms, understand the importance of them and agree to be bound by them.
You are granted a personal and non-transferable privilege to use the services as long as you comply with these Terms and Conditions and any modifications, our Privacy Policy and any other notices, guidelines and rules published by us.
If you disagree with any part of these Terms and Conditions, please do not use our Services.
2 BOOKINGS/CANCELLATIONS/REFUNDS/PURCHASE TERMS
Bookings can be made by phone, email or through the website and can be paid for by credit card, cash or bank transfer. Payments must be made in advance of attendance – receipt of payment will confirm your booking.
All new clients must complete a client questionnaire & Covid-19 screening and consent form before attending their first class or using the Services.
All fees are strictly non-refundable unless otherwise specified by FlowMotion Pilates.
All bookings made (private, duet or classes) are strictly non-transferable.
There may be times when bookings may be purchased as a gift. In these instances FlowMotion Pilates must be notified and agreement received in advance.
If you need to cancel with less than 24 hours’ notice you will be charged at the full rate. If you need to cancel please call/text (07827913561) or email at the earliest opportunity.
Block booking payments are non-refundable otherwise specified by FlowMotion Pilates. Block bookings for 5 sessions expire 2 months from date of purchase and for 10 sessions it is 4 months.
Prices quoted on the website and any promotional materials for private sessions vary dependent on location and terms of agreement. Please contact us for a more accurate quote.
The client should check the terms on every purchase as these may change from time to time without notice.
We reserve the right to withdraw any special offers at any time without notice.
If you or anyone in your household have a temperature or think that you have any of the symptoms related to Covid-19, please do not attend the class.
If you have been contacted by “Track and Trace” and been asked to isolate due to proximity with someone with a positive Covid-19 test, please do not come to the class until your isolation period is over.
3 CHILDREN
One-to-one Pilates for children sessions are available for ages 8-18 but must be agreed in advance with the instructor.
Children may not accompany you to any session that you book for yourself unless this has been specifically agreed with the instructor in advance.
4 INJURIES AND HEALTH – IMPORTANT WAIVER / LIMITATION OF LIABILITY
Pilates classes and other services can involve strenuous exercises. It is your sole responsibility to check with your doctor or medical practitioner about your suitability to use our Services and to obtain their consent.
While we take care to ensure safe practice, there are inherent risks in any strenuous exercise programme and we accept no liability whatsoever for any injury or illness you incur through taking our Services and/or by your failure to notify us of any existing injuries or health problems or special needs before you attend your class with us, or to notify us prior to the start of each class.
All information on our website is intended for general information purposes only. It is not intended to constitute professional medical advice. The information should not be relied on or treated as a substitute for medical or clinical advice. FlowMotion Pilates accepts no responsibility for loss which may arise from accessing or reliance on information contained on our website.
5 BEHAVIOUR
We do not tolerate any abuse, harassment or violence. We reserve the right to withdraw any agreed services with you, without refund, if we deem your behaviour to be unacceptable or breach our terms and conditions.
AGREEMENT BY CLIENT
By purchasing, booking or using the services of FlowMotion Pilates, I (the client) agree and acknowledge that:
I am aware that it is advisable to consult a physician prior to participating in strenuous exercise or lifestyle changes, especially if I am overweight, pregnant, nursing, regularly taking medications, or have any existing medical conditions. If I have consulted a physician, I have taken the physician’s advice.
I will notify the studio of any health problem or injury I have, including without limitation cardiac irregularities, spinal, bone, joint, tendon or ligament injuries, spells of dizziness, asthma or other breathing difficulty, diabetes, epilepsy or any allergy, which may affect my participation in, or may be exacerbated by, any Services at FlowMotion Pilates. I will also notify the instructor at the beginning of every class of health issues or circumstances that may have arisen or worsened since the previous class.
I am fully aware that participation in any strenuous exercise program involves risks and I fully accept all the risks of using the services of FlowMotion Pilates.
I am in proper physical condition to participate in Pilates classes. I am aware that participation could, in some circumstances, result in serious physical injury.
I am aware that there is no obligation for any person to provide me with medical care during any activity. I understand and acknowledge that there may be no aid stations available for the activity. If medical care is rendered to me, I consent to that care if I am unable to give my consent for any reason at the time the care is rendered.
I understand that these terms and conditions cover any activity in any class venues or external event run by FlowMotion Pilates.
I will notify the instructor immediately of any pain and/or discomfort felt during any activity. I will stop exercising and seek medical advice if I feel dizzy, faint, light-headed or if I experience any discomfort. I agree that only I can monitor my condition during my workout.
I fully accept responsibility for exercising within my limits and seeking attention and advice as appropriate. I will never force or strain.
I will avoid alcohol and or heavy meals for 2 hours before workouts. I will drink fluids (preferably water) before, during and after workouts. I accept that my health is my responsibility and I participate at my own risk.
I have filled out a health questionnaire accurately. I will keep this information up to date of any changes to the answers.
I accept the risk of injury from performing exercises and using specialist equipment. I acknowledge and accept that any advice provided by FlowMotion Pilates at no time constitutes as professional medical advice or substitution for my own professional medical advice.
I agree and understand that I must follow the strict instructions of the instructor in each and every Service I take. FlowMotion Pilates cannot be held responsible for any injury arising or being made worse by my failure to do so.
By signing the Client Registration form I acknowledge that I have voluntarily chosen to participate in a practice of progressive physical exercise. I understand my own body’s challenges and take full responsibility for my Pilates practice.
It is hereby understood that Cristina Woodall and FlowMotion Pilates accepts no responsibility for accident, injury, illness, loss or misadventure caused to or suffered by me.
PRIVACY AND PROTECTION OF PERSONAL DATA
FlowMotion Pilates will act in line with the GDPR (General Data Protection Regulations).
